Auctions
Auctions usually take place pursuant to the mortgage lien, but may also take place pursuant to a foreclosure or court order.
An auction under a mortgage always involves default by the debtor to the bank. Usually, interest and/or principal payments are no longer paid (on time). The bank (mortgagee) is then authorized to publicly sell the registered property pledged as collateral in the mortgage deed.
When the mortgagee requests the notary to proceed with the auction, an auction date is mutually agreed upon, which is served on the interested parties by the bailiff. Then the advertisement announcing the auction will be published in various newspapers. The auction will also be announced on this website under current auctions.
Private bids may be made in writing to the notary up to fourteen days prior to the auction date. These private bids will be forwarded by the notary to the bank and owner of the collateral. If the bank accepts the offer, the purchase agreement will be drafted and submitted to the court for approval. Once the offer is approved by the judge, the sale will proceed and the auction will be canceled.
